Within how many days must an invoice be sent to e-Factura in 2026?
The deadline moved from calendar days to working days, which changes the arithmetic in any week with a public holiday. The difference is practical: an invoice issued on a Friday no longer expires on the Wednesday.
Short answer
- The deadline for transmission to the RO e-Factura system is 5 working days from the invoice date.
- It cannot exceed 5 working days from the statutory deadline for issuing the invoice.
- Working days exclude Saturdays, Sundays and public holidays.
- The rule comes from OUG 89/2025, which amended art. 10 para. (7) of OUG 120/2021.
- An invoice counts as transmitted when the system receives it, not when the XML file is generated.
What the law says
- OUG 120/2021 governs the national RO e-Factura system, and art. 10 para. (7) sets the transmission deadline.
- The amended text provides for 5 working days from the invoice date, but no later than 5 working days from the invoicing deadline in art. 319 para. (16) of the Fiscal Code.
- The statutory invoicing deadline is, as a rule, the 15th day of the month following the chargeable event.
- The period runs from the issue date, not from the date the invoice was booked.
- Exceeding the deadline is an offence distinct from failing to transmit at all.
Practical examples
- An invoice issued on Monday 5 October is due by Friday 9 October, absent a public holiday.
- An invoice issued on a Friday is due by the following Thursday: Saturday and Sunday do not count.
- In a week containing a public holiday, the deadline extends by one further calendar day.
- An invoice for a 20 September supply, issued on 15 October, meets both deadlines if it reaches the system within 5 working days of 15 October.
Common mistakes
- Counting calendar days under the old rule and missing the deadline in weeks with holidays.
- Generating the XML on time but never uploading it — the deadline refers to receipt by the system.
- Not checking the status after upload: an invoice rejected on validation errors does not count as transmitted.
- Leaving transmission to the last day, with no margin to fix a validation error.
How 4conta helps
4conta transmits invoices to RO e-Factura through the ANAF private-space integration right after issue, so the five-working-day deadline never becomes a constraint. The working-day calendar includes public holidays, and untransmitted invoices appear in a separate list ordered by remaining time.
The status returned by ANAF is attached to the invoice: a validation rejection is flagged and resent after correction, rather than silently passing as transmitted.
